1. General provisions relating to these general conditions of sale
These general conditions of sale, hereinafter the “CGV, apply to all orders placed on the website at the address www. motoblouz, hereinafter the "Site", published by the company D3T DISTRIBUTION , hereinafter " MOTOBLOUZ ", Simplified Joint Stock Company with capital of €9,041.75, registered with the RCS of Arras (France) under number 478 566 250, having its registered office at 72 rue Elie Cartan, artisanal zone of the Gare d'Eau 62220 CARVIN, represented by Mr. Jérôme Dalidet.
The General Terms and Conditions are made available to Internet users, visitors or Customers, on the Site where they are directly consultable and can also be communicated to them on simple request by any means.
By registering on the Site, the Customer confirms having read the General Terms and Conditions and accept them, making him contractually bound by their terms. MOTOBLOUZ reserves the right to adapt or modify the General Terms and Conditions at any time. In the event of modification, the General Terms and Conditions in force on the day of the order will be applied to each order.
MOTOBLOUZ reserves the right to modify at any time and without notice the content of the Site or the services available there, and/or to temporarily or permanently cease operating all or part of the Site.
2. Our offer
All offers of products, services and delivery terms, at prices indicated in Euros, are valid in the territories of the Member States in which MOTOBLOUZ markets its products, within the limits of available stocks.
The VAT rate applied varies depending on the country in which the order is placed.
For orders outside the European Union, the products will be invoiced excluding taxes and you will have to pay shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will have to pay customs duties and local VAT depending on the country of destination. The amount of shipping costs will be indicated to you when choosing the delivery method.

A description with the essential characteristics of the product is present on each item we sell. However, some minimal variations may occur, which is why it is recommended to contact our customer service if in doubt.
The photographs illustrating the products and their description do not constitute a contractual document.
Our teams do what is necessary to provide a faithful image of the products offered for sale through the images or photographs used for their presentation. Variations may nevertheless appear in particular due to technical limitations, color rendering or customer equipment (internet browser, screen used). Motoblouz therefore recommends that the customer refer to the description of the products appearing on the site to find out their essential characteristics.
Except in the case of warranty (see article 10 below), any operation between Motoblouz and its customers, not contested within 14 days following delivery, cannot give rise to a complaint.
3. Creation of a customer account
To place an order on the Site, the Customer must first create their personal customer account. Once created, to access it, the Customer must identify themselves using their username and personal and confidential password.
Each Client undertakes to maintain strict confidentiality regarding the data, in particular username and password, allowing them to access their client area, the Client acknowledging that they are solely responsible for access to the service through their username and password, unless fraud is proven.
Each Customer further undertakes to inform MOTOBLOUZ immediately in the event of a loss, misappropriation or fraudulent use of their identifier and/or password.
After creating their personal customer area, the Customer will receive an email confirming the creation of their customer area. The Customer undertakes when registering to:
- deliver real, accurate, up-to-date information at the time of entry into the service registration form, and in particular not to use false names or addresses, or names or addresses without being authorized to do so
- keep registration data up to date to ensure that it is real, accurate and up to date at all times
The Client further undertakes not to make available or distribute illicit or objectionable information (such as information constituting identity theft) or even harmful information (such as viruses). Otherwise, MOTOBLOUZ will be able to suspend the Customer's access to the Site at its sole discretion.
The Customer acknowledges that the characteristics and constraints of the Internet do not guarantee the security, availability and integrity of data transmissions over the Internet.
Therefore, MOTOBLOUZ does not guarantee that the Site and its services will operate without interruption or malfunction. In particular, its operation may be temporarily interrupted due to maintenance, updates or technical improvements, or to change the content and/or its presentation. MOTOBLOUZ cannot be held responsible for any use made of the Site and its services by Customers in violation of these General Terms and Conditions and for any direct or indirect damage that this use could cause to a Customer or a third party.
In particular, MOTOBLOUZ cannot be held responsible for false declarations made by a Customer.
In the event that MOTOBLOUZ is held liable for such fault on the part of one of its Clients, the latter undertakes to guarantee MOTOBLOUZ against any conviction pronounced against it as well as to reimburse it for all costs. , in particular representation to assert one's rights before the Courts.
4. Order
The order can only be registered on the site if you have clearly identified yourself either by entering your username and password, which are strictly personal to you, or by creating an account on the website www. motoblouz if you are not yet registered.
Any order constitutes acceptance of the prices and description of the products available for sale. The contract is formed when the confirmation of your order is issued. As soon as your order is validated, it will be transmitted to our logistics services for processing. You will receive a premier automatic acknowledgment email within the hour.
We remind you that validating an order implies the obligation to pay the indicated price.

5. Price
Prices are indicated in euros (€) and take into account the country's VAT in force.
In the event of a promotion, MOTOBLOUZ undertakes to apply the promotional price to any order placed during the period covering the promotion.
The price is due in full after confirmation of the order. The prices displayed include discounts and rebates that MOTOBLOUZ may offer.
If delivery or transport costs apply (see article 7 below), they will be added to the price of the order and indicated separately before validation by the Customer. The total amount owed by the Customer and its details are indicated on the confirmation page of each order.
6. Payment and security
6.1 by bank card
Payment is made via the secure payment interface of our partner Glopal when ordering on motoblouz . Payment by credit card is perfectly secure. Motoblouz certifies that it does not hold any banking information entered during the order process. All banking details are transmitted in real time to our partner Glopal. For purchases made on the web, your account will be debited at the time of validation of your order.
Payment security: your credit card details are encrypted using the TLS (Transport Layer Security) protocol and never pass unencrypted over the network. Payment is made directly to the bank. Motoblouz does not have access to these contact details under any circumstances, and does not keep them on its servers. This is why you are asked for them again for each new transaction on our site.
6.2 retention of title clause
The products remain the property of MOTOBLOUZ until the order has been fully collected by Motoblouz . However, upon delivery, the risks of the goods delivered are transferred to the customer.
6.3 failure to pay
MOTOBLOUZ reserves the right to refuse to make a delivery or to honor an order from a consumer who has not fully or partially paid a previous order or with whom a payment dispute is being administered.
6.4 anti-fraud control
Securing your orders on Motoblouz is a major concern. This is why orders are checked before shipping.
As part of this control and in order to combat fraud and the usurpation of means of payment on the Internet, Motoblouz may ask the customer to provide proof of identity and address. Depending on the date of receipt, the shipping time for your order may be extended.
If the check of these documents proves favorable, the order will be validated. Otherwise or in the event of non-receipt, Motoblouz reserves the right to cancel the order. It would then be canceled and then refunded.
7. Delivery terms and times
7.1 shipping terms
MOTOBLOUZ undertakes to respect as much as possible the shipping date given to you as an indication in the summary of your order and on the order confirmation email. A delivery date will also be indicated to you, once you have chosen the delivery method that suits you best.
When ordering several items, the delivery time to be taken into account is the longest. For example, if you order a jacket shipped within 48 hours and a helmet shipped within 7 days then the entire order will be shipped within 7 days.
Packages are shipped Monday through Friday, excluding public holidays.

If you are absent during delivery :
If the size of your package allows it, it will be placed in your mailbox.
Otherwise, a delivery notice will be left for you, inviting you to collect your package from a post office or relay point near you.
These prices may be subject to specific commercial operations. The delivery times indicated are in working days, and indicated as an estimate.
If you place a very large order (approximately a palette of products), delivery may be tailor-made and the delivery time may be extended. In this case, a motorcycle advisor will contact you.

If the order is very large (approximately a palette of products), delivery can be made to measure and the delivery time may be extended. In this case, a motorcycle advisor will contact the customer.
When the customer chooses their preferred mode of transport, the name of the carrier does not appear at this stage. To ensure the best quality of service, Motoblouz works with several carriers, for each type of delivery.
In other words, the customer chooses the mode of transport that suits him best, and Motoblouz decides on the carrier likely to satisfy this request under the best conditions (based on price, quality of service, your place of delivery).
The customer will be aware of the carrier used when shipping their order. An email will then be sent to them, indicating in particular the name of the carrier chosen, as well as the tracking number of their package.
For transport reasons, products (fluids, tires, etc.) cannot be shipped to certain countries.
In case of absence upon delivery :
- If the size of the package allows it, it will be placed in the customer's mailbox.
- Otherwise, the carrier will indicate its withdrawal methods.
7.3 taxes applied to orders
For orders to destinations outside the European Union, the products will be invoiced excluding taxes and the customer will have to pay shipping costs calculated according to the country of destination and the weight of the package. Upon receipt of the package, you will have to pay, in addition, customs duties, VAT and other local taxes, depending on the country of destination:
- all duties and taxes are calculated, by the customs services, on the amount of the order including transport
- if the customer chooses an "express" carrier, then the latter will additionally charge him a flat-rate administration fee (generally between 20 and €29.50), corresponding to the fact that he carries out, by customs delegation, the calculation and collection of duties and taxes, which saves the customer time on delivery.
7.4 ADDITIONAL INFORMATION
No compensation can be claimed if an item cannot be delivered: either following an unforeseen manufacturing stoppage, or following strikes, accidents, natural disasters, inability to obtain supplies or all other causes beyond our control.
Delivery of orders is impossible on public holidays.

8. Right of withdrawal
In accordance with Directive 2011/83/EU of October 25, 2011 relating to consumer rights transposed into the national legislation of the Member States, you have a period of 14 calendar days from receipt of your items to exercise your right to withdrawal without having to justify your decision or incur any other costs.
In the case of an order for several items delivered separately, the period runs from receipt of the last item.
To exercise your right of withdrawal, you must notify the company D3T DISTRIBUTION of your decision either by means of the withdrawal form, duly completed, presented below in the General Conditions of Sale, or by any unambiguous correspondence expressing your desire to withdraw:

In the event of exercising the right of withdrawal, we will reimburse the sums paid, including the cost of delivery:
- at the latest within 14 days from the date on which we are informed of your decision to withdraw, this date being however deferred until receipt of the returned item(s) or proof of their shipment, the date chosen being that of the premier of these facts ;
- using the same means of payment as that used at the time of the order, unless another means of reimbursement agreed between the parties.
We inform you that if you have chosen a more expensive delivery method than the standard delivery method, the delivery costs will be refunded to you up to the cost of standard delivery.
You are required to return or return the item(s) within 14 days following communication of your decision to withdraw, with the return costs being your responsibility.
9. Product return conditions (excluding legal or commercial guarantees)
9.1 when to return the product?
You have 60 days from the date of receipt to return the items to us for a refund.
9.2 how to return the product?
Return the item in the box in which it was sent to you or in an identical box (reinforced, same size) if the premier has been damaged. Please note, commercial packaging is not made for the transport of goods. In order to preserve the original box of the item, the return must be made by packing it in a cardboard box as during the initial shipment.
9.3 conditions for your return to be accepted?
You have 60 days from the date of receipt to return the items to us for a refund.
Items must be unused, in their original packaging and must have labels. Certain products cannot be returned: custom-made, personalized, perishable or edible items.
If these products are returned, we will reship them. If they are returned again, we reserve the right to keep them without refund.
Return of damaged or incorrect items must be approved by our Customer Service.
If the item is damaged, incorrect or not compatible, your return shipping cost will be refunded if your request is approved.
We reserve the right not to accept returns of defective items without an approved claim.
If you would like a new item, please return the item received for a refund. You will then need to place a new order. Shipping costs for the second shipment as well as return costs are not refundable.
Please note: The After-Sales Service reserves the right to refuse the return if one of the conditions is not respected, the package will then be returned directly to you.
9.4 how to make your return request?
Find in your order history the one that concerns the item in question (it must be less than 60 days old). The process will be explained to you step by step, but be sure to print the summary to attach to your package.
The return of item(s) is carried out by your own means, the cost being your responsibility.
You are invited to specify, where applicable on any document from the customs authorities, that this is a return of product(s), in order to avoid having to bear additional taxes.
10. Product Warranty
10.1 COMMERCIAL GUARANTEE
The products sold are covered by a commercial guarantee aimed at guaranteeing their conformity and ensuring reimbursement of the purchase price, replacement or repair of the goods. It does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the products or defects mentioned on the product sheet in the context of "second choice/reconditioned" products.
Information concerning any commercial guarantees relating to the products and services offered for sale (in particular the content of the guarantee, the terms of its implementation, its price, its duration, its territorial extent as well as the name and address of the guarantor depending on the products, services and brands concerned) are brought to the attention of the customer where applicable on the sheet of each product and service in the online sales area.
10.2 LEGAL GUARANTEE
Independently of the commercial guarantee presented above, the products benefit from the legal guarantee of conformity defined in EU Directive 2019/771 of May 20, 2019 relating to certain aspects concerning contracts for the sale of goods, transposed into the national legislation of the States members.
When you act within the framework of the legal guarantee of conformity, you benefit from a period of two (2) years from the delivery of the goods to act

At any time, and in application of articles 15 to 21 of the General Data Protection Regulations, you have a right of access, rectification, erasure, limitation of processing, portability and opposition.

12. Completeness
These general conditions of sale constitute the contract governing relations between the Customer and MOTOBLOUZ .
They constitute all of the rights and obligations governing these relationships.
If one or more stipulations of these general conditions of sale are declared void in application of a law, a regulation or following a final decision of a court, the other stipulations will retain their full force and scope.
Furthermore, the fact for one of the parties not to take advantage of a breach by the other party of any of the stipulations of these general conditions of sale cannot be interpreted as a waiver on their part of take advantage of it later.
13. Dispute resolution
These general conditions of sale are subject to the national law of the Member State defined in accordance with the provisions of EC Regulation No. 593/2008 of June 17, 2008 relating to the law applicable to contractual obligations, particularly Article 6.
Any complaint related to the execution or interpretation of the contract must first be submitted in writing to the customer service of the company D3T DISTRIBUTION either by email by clicking on this link, or via the contact form accessible on the website www. motoblouz.
In addition and in accordance with Article 14 of Regulation (EU) No. 524/2013 of May 21, 2013 relating to the online settlement of consumer disputes, MOTOBLOUZ informs you that the European Commission has set up a platform intended to collect consumer complaints following an online purchase in order to then transmit them to the competent national mediators.

Any dispute or litigation arising from the execution or interpretation of these general conditions of sale, which has not been resolved amicably by the parties, will be subject to the jurisdiction of the Court established in accordance with the rules of civil procedure defined in EU Regulation No. 2015/20212 of December 12, 2012 in particular relating to judicial jurisdiction, particularly Article 7.
